Abstract : The examination of documents and visual inspection of the dam and appurtenant structures did not reveal conditions which constitute an immediate hazard to human life or property. The dam, however, has a number of problem areas which should be investigated further. The structural stability analysis indicates unsatisfactory stability for the dam when subjected to forces which could occur during winter operations (including ice loading), the Probable Maximum Flood (PMF), and 1/2 PMF events. A structural stability investigation of the dam should be started within 6 months to determine the effect of the dam’s steel bar anchor system and the uplift forces acting on the base of the dam. Remedial measures should be completed within 2 years to increase the structural stability of the facility to meet the Corps of Engineers screening criteria. The hydrologic/hydraulic analysis establishes the spillway capacity as 46% of the Probable Maximum Flood (PMF) with the sluice gates open and 30% of the PMF if the gates remain closed throughout the storm. The dam will be overtopped by 2.72 feet by the PMF with the gates closed or 2.55 feet with the gates opened. However, the spillway is capable of passing the 1/2 PMF under either of these two conditions without the dam being overtopped. Therefore, the spillway is assessed as inadequate according to the Corps of Engineers screening criteria.

ALBANY—A small war of words has broken out between the Army Corps of Engineers and angry residents of Lake George over a recent declaration by the engineers that the lake is a “navigable waterway of the United States.”

By the decision, taken with little public notice in December, the United States exercised its sovereignty over the waters and shoreline of the lake, subjecting it to the rules and regulations of the Federal Government. Before that, Lake George, which is entirely within the boundaries of New York State, had been governed by the laws of the state.

“We consider the move to acquire such control an unwarranted and unnecessary invasion of the state’s domain,” according to Alton C. Warner, president of the Lake George Association, which represents 1,200 families.

Already, some residents are complaining about bureaucratic delays in new procedures that require them to apply for a permit and seek approval from the engineers before they can build a dock or a retaining wall on the shoreline.

The site of the battle is a 44‐square‐mile lake, long a favorite vacation resort for New Yorkers, in Warren County. At its northern end, its waters flow into Ticonderoga River and then into Lake Champlain, which borders on New York, Vermont and Canada.

The waters of Lake Champlain drain into the Richelieu River, which, in turn, empties into the St. Lawrence River. In addition, Lake Champlain is connected directly to the Hudson River by the Champlain Barge Canal.

“Therefore,” a formal finding by the engineers declared, “it can be concluded that Lake George forms a significant portion of a continuous interstate and international body of water that stretches from Lake George, N.Y., to Vermont, New York Harbor and Sorel, Quebec, Canada.”

“A new high in absurdity,” Mr. Warner replied. “As every schoolboy in the lower grades in this area knows, the water from Lake George plunges 200 feet downward over a series of former mill dams in Ticonderoga Creek before reaching the level of Lake Champlain. That outward drop is about as navigable as is Niagara Falls.”

But the Corps of Engineers also went back more than 200 years for its precedent, under the theory of “once navigable, always navigable.”

In 1758, according to its documents, the British general Sir James Abercrombie launched more than 900 boats from Lake George in an illfated campaign against Fort Ticonderoga, the strategic pivot built by the French to control both Lake George and Lake Champlain.

At the district headquarters of the engineers in New York City, Robert Campbell said that Lake George had not been singled out, but that it and other bodies of water had been re‐evaluated because of a recommendation by a House of Representatives committee, recent court decisions and a number of environmental lawsuits.
