The examination of documents and visual inspection of the dam and appurtenant structures did not reveal conditions which constitute an immediate hazard to human life or property. The dam, however, has a number of problem areas which should be investigated further. The structural stability analysis indicates unsatisfactory stability for the dam when subjected to forces which could occur during winter operations (including ice loading), the Probable Maximum Flood (PMF), and 1/2 PMF events. A structural stability investigation of the dam should be started within 6 months to determine the effect of the dam’s steel bar anchor system and the uplift forces acting on the base of the dam. Remedial measures should be completed within 2 years to increase the structural stability of the facility to meet the Corps of Engineers screening criteria. The hydrologic/hydraulic analysis establishes the spillway capacity as 46% of the Probable Maximum Flood (PMF) with the sluice gates open and 30% of the PMF if the gates remain closed throughout the storm. The dam will be overtopped by 2.72 feet by the PMF with the gates closed or 2.55 feet with the gates opened. However, the spillway is capable of passing the 1/2 PMF under either of these two conditions without the dam being overtopped. Therefore, the spillway is assessed as inadequate according to the Corps of Engineers screening criteria.

The State of New York and the State of Vermont with Federal Authorities have been DECADES pointing out the  FLUSHINGS of vast amounts of Sewage and Toxins using the DAM ” A ”  Structure at  Weedville and Alexandria Avenue where Lake George is Flushed into the LaChute River.
 
A .  The Dale Engineering Company hired by New York State to Inspect the Dam ” A ”  in 1980 reveals the Dam’s Release  Design is NOT of Adequate Size to let water leave Lake George during SPRING THAW and SNOW PACK MELT or the Spring Rains.   ( The John B. B.    For many DECADES  the  State of  New York is suing the Owners of  Dam ” A ”  because the  WEALTHY PROPERTY OWNERS want a  level and full Lake during  BOATING SEASON.   The  Lake  George  Steam Ship  Co.   and  the  Lake  George Association,  Warren  County  and  the  State wants  a  FULL LAKE and go to Court over decades to  keep the  Lake  Level Controlled and  High  for the  purposes  of  REVENUE  GENERATION.
 
C.   The State’s  Lake George Park Commission describe what the  Dale Engineering Company and John B. Stetson reveals is  a   ”  PIN  HOLE   IN  A  BATH  TUB  ”   or  the  Inadequate  Dam  Operational Capacity of the   DAM ”  A  “.
 
 
D.    Considering  all the  above ……  DURING  THE  WINTER …….  Lake George is  DRAINED  or  FLUSHED   or    DRAWN DOWN  to prevent an  OVER TOPPING   of  the  DAM  and EXTREMELY  High  Water  in every Spring  Rain and  Thaw  Season  going back  to  When  the  Paper  Mills were doing   THE  VERY SAME  THING   so  the  POWER COMPANY  and  the  PAPER MILLS  could  MAKE  LOTS  AND  LOTS  OF  MONEY  for  the  Corporations   and  the  STATE /   COUNTY  /  FEDERAL  GOVERNMENT.
 
E.    All the  Years  above  The  STATE OF NEW YORK  complains  that   Private Docks,  Boat  Houses,   Islands, Bulkheads and  Shoreline are being   DAMAGED  and  DESTROYED.   Destroyed and Damaged    EXACTLY  LIKE  WHAT WAS  DONE  …….   Many  Years  to  THE  WITHAM  MARINA.
 
OK  Lets  see ……   EXAMPLE …….  There is  a  FLEET  OF  SEMI  TRUCKS  and  COMMERCIAL  AIRLINERS   and  TRAINS /  RAIL  ROADS   Operating and  their  Extremely  Heavy  Transportation  SYSTEMS  are  merely  46 %   Capable of functioning the  way  They Are Suppose  To.     Year after Year  After  Year   Huge Amounts of  Property and  People are Being  DAMAGED  and  DESTROYED   because  the  Systems  Being Operated  are   WHOLLY  INADEQUATE.
 
To  Governor  Andrew  Cuomo,   Warren County  DA  Hogan,   Warren County  Attorney,  Warren County  Board of  Supervisors,   Basil  Seggos,  Eric Schneiderman,   New York State Assembly,   Towns of  Queensbury, Lake George, Diamond Point,  Bolton,  Hague,  Huellets Landing  etc  etc etc etc   ET  AL ……..
 
DAM  ” A  ”   and  it’s   Operators   NEW  YORK  STATE   and  the  INTERNATIONAL  PAPER  with  SYSTEMS  PROPERTIES   and  now  ENEL  POWER  and  the  LAKE  GEORGE  PARK  COMMISSION   are  doing the  VERY  SAME  THING …….   FLUSHING  LAKE  GEORGE  IN  THE  WINTER.     Causing the  VERY  SAME  DAMAGES  and  DESTRUCTION  the  State of  New  York  filed  Criminal  Charges  and  Sued  Over for  many  years.
 
In the  1950s  and  1960s   even the  70s  and  80s and  90s    THE  INTERNET was not capable of  NOR did the  records and Newspapers  have the  above  information  available on the  Net.    I was repeatedly told such things as,  ALL  THE  RECORDS  VANISHED  IN  A  FLOOD  during  Hurricane  Sandy  (  US  ARMY  )     NYS  DEC  has  not only remained  SILENT …..  They have  REFUSED  to  provide any records  when  FOIL  requires them to.  DEC  has  remained  SILENT  (  Taken  the  5th  ).     Warren  County,  Ticonderoga, Lake George, Queensbury etc etc etc   HAVE  MANY  MANY  MANY  Times  Claimed  ……..    They  HAVE  NO  RECORDS  OR  FILES
 
The  Lake  George  Park  Commission  and  DEC  have  NOT  cooperated in any way  shape or  form and have failed to produce ANY RECORDS.
 
POINT  IN  FACT  ……..   How is  ANYONE  such  as  Myself  to  DISCOVER  THE  FACTS   and  DECIPHER  those  RECORDS  and  FILES  that  the  Government   HAS  NEVER  PRODUCED   to  Understand  A  CAUSE  OF  ACTION  EXISTS ?????????????????
 
How is ANYONE to  KNOW  or  How  Could  They  Know  They Had  a  Cause  Of  Action  when  They are  Not  Being Informed of  the  Facts   BUT  Those  Facts  are  being  HIDDEN  and  CONCEALED  (  See  the  Concealment  Doctrine )
 
 
FOIL  DEMAND  ……  Recently  I  was  approached  by  STATE  POLICE  and  US  Marshal  Detectives  asking Me  about  these  matters.   I am to understand  that   Raybrook  DEC,   The  Warren County  Sheriff’s  Office and other  New  York  State  Authorities   REPORTED ME  INTERSTATE   for making  some  sort  of  THREATS ??   When I demanded from the  Detectives  the  SPECIFIC  Claimed  Threats  I was  being  Investigated  For …… They replied  with some  BALD  and  VAGUE ,  AMBIGUOUS  Information something about  a  DIRTY  BOMB allegation.
 
This  FOIL  Demand  is  to  New  York State  Police,  Warren County  Sheriff Bud  York  and  Major  James  Lafarr as well as  the  DEC  Law Enforcement  Offices ……..  ANY ALL AND  EVERY  Investigative  File,  Complaint,   Investigation  File,  Report,  NCIC  Access,   Complaints  made  to  Federal or  Inter State  Authorities   that  I am  MAKING  THREATS  or  ENGAGED in any  FOIL  or  FOIA  investigation Activities …….   Produce  those  Reports,  Investigations  and  Records.
 
In closing ……  Clifford and  Anita  Witham’s  Family  Marina  was  repeatedly  destroyed  causing  ENORMOUS  Financial  Damages  to the  Witham  Family.   All  records and files  under  the  control  of  New  York, it’s  Agencies and  Political Subdivisions as well as  the  US  Army,  NOAA,  EPA,  DEC,  any Government  Office  or  Agency  that has information  about    THE  PINHOLE  IN  THE  BATH  TUB  …….   DAM  “A”   and  Ice  and  Snow  Sheet  Destruction  of  Docks,  Boat Houses,  Marinas,  Shoreline or  Islands on  Lake  George,  NY ……. especially  the  NEW YORK  STATE  ATTORNEY  GENERAL   and    NEW YORK STATE  SENATE  and  NEW  YORK  STATE  POLICE  and  NEW YORK  STATE …….   Per  FOIL  and  FOIA …..  Produce  those  Films,  Photos,  Records  and  Files.
